Ghair Mahram Auraton Se Musaafaha?
Ghair Mahram Auraton Se Musaafaha Karna Mamnoo Aur Haraam Hai:
1) Ummul Momineen Sayyidah Aisha (Razi Allahu Anha) bayaan karti hain:
والله ما اخذ رسول الله صلى الله عليه وسلم على النساء إلا بما امره الله؛ يقول لهن؛ إذا اخذ عليهن قد بايعتكن كلاما
"Allah ki qasam! Rasoolullah ﷺ ne auraton se sirf un chizon ka 'ehad liya, jin ka Aap ﷺ ko Allah تعالٰی ne hukm diya tha, bait letey waqt Aap ﷺ unse farmaatey: maine tumse zubani 'ehad ley liya hai."
(Sahih Bukhari: 5288, Sahih Muslim: 1866)
2) Umaimah Binte Ruqaiqah (Razi Allahu Anha) bayaan karti hain ke Rasoolullah ﷺ ne farmaaya:
إِنِّي لَا أُصَافِحُ النِّسَاءَ
"Main (ghair mahram) auraton se musaafaha nahi karta."
(Muwatta Imam Malik: 2/982, Musnad Ahmed: 6/357, Wasanadahu Sahih)
Ek riwayat mein ye alfaz hain:
ولم يصافح رسول الله صلى الله عليه وسلم منّا امراة
"Rasoolullah ﷺ hum auraton se musaafaha nahi karte they."
(Musnad Ahmed: 6/357, Mustadrak Lil Hakim: 4/71, Wasanadahu Hasan)
3) Sayyiduna Abdullah Bin Umar (Razi Allahu Anhuma) ka bayaan hai:
إنّ رسول الله صلى الله عليه وسلم كان لا يصافح النّساء في البيعة
"Rasoolullah ﷺ auraton se bait letey waqt musaafaha nahi karte thhey."
(Musnad Ahmed: 2/213, Wasanadahu Hasan)
4) Sayyiduna Ma'qil Bin Yasaar (Razi Allahu Anhu) se riwayat hai ke Rasoolullah ﷺ ne farmaaya:
لان يّطعن في رأس أحدكم بمخيط مّن حديد؛ خير لّه من أن يّمسّ امراة لّا تحلّ له
"Tum mein se kisi ke sar mein lohe ki sooyi chuboyi jaye tou yeh behtar hai is se ke wo kisi na mahram aurat ko chooye."

1) Faaidah:
Imam Ibrahim an-Nakhayi Tabayee Rahimahullah se riwayat hai:
کَانَ النَّبِيُّ صَلَّی اللّٰہُ عَلَیْہِ وَسَلَّمَ یُصَافِحُ النِّسَائَ، وَعَلٰی یَدِہٖ ثَوْبٌ
"Nabi E Kareem ﷺ auraton se musaafaha kiya kartey thhey, lekin Aap ﷺ ke hath par kapda hota tha."
(at-Tamheed Limaa fi al-Muwatta Minal Ma'aani Wal Asaneed Li Ibne Abdul Barr: 12/243)
Tabsira:
Yeh sakht "zaeef" riwayat hai, kiyunke:
1) Yeh Ibrahim an-Nakhayi ki "Mursal" hai, aur mursal riwayat "za'eef" hoti hai.
2) Imam Sufiyaan ki "Tadlees" bhi maujood hai. Is kitaab mein Ata Bin Abi Rabah ki "Mursal" riwayat bhi hai, lekin is mein bhi Sufiyaan ki "Tadlees" hai. is tarha Khais Bin Abu Hatim ki ek "Mursal" bhi hai.

Lekin yeh riwayat bhi Ismail Bin Abi Khalid aur Sufiyaan ki "Tadlees" ki wajah se "za'eef" hai.
2) Faaidah:
Sayyiduna Ma'qil Bin Yasaar (Razi Allahu Anhu) se riwayat hai:
وَکَانَ یُصَافِحُ النِّسَاء َ مِنْ تَحْتِ الثَّوْبِ
"Aap ﷺ khwateen se kapde ke nichey se musaafaha kartey thhey."

Yeh sakht tareen "za'eef" riwayat hai, kiyunke:
- 'Ataab Bin Harb Abu Bashr Muzani jamhoor muhaddiseen ke nazdeek "za'eef" hai.
- al-Muzaa al-Khazzar rawi "Majhool" hai.
- Yunus Bin 'Ubaid rawi "Mudallis" hai.
- Imam Hasan Basri ki "Tadlees" bhi maujood hai.
3) Faaidah:
● Fiqh e hanafi ki mo'tabar tareen kitabon mein ek riwayat yun bayaan ki gayi hai:
مَنْ مَّسَّ کَفَّ امْرَأَۃٍ لَّیْسَ مِنْہَا بِسَبِیلٍ؛ وُضِعَ فِي کَفِّہٖ جَمْرَۃٌ یَّوْمَ الْقِیَامَۃِ، حَتّٰی یُفْصَلَ بَیْنَ الْخَلَائِقِ
"Jis shaksh ne kisi ghair mahram aurat ki hatehli ko chuwa, uski hatehli mein roz e qayamat angara rakkha jayega jab tak ke tamaam logon ka faisla nahi kardiya jaata."

● Ek aur riwayat yun bayaan huwi hai:
إِنَّ النَّبِيَّ صَلَّی اللّٰہُ عَلَیْہِ وَسَلَّمَ کَانَ یُصَافِحُ الْعَجَائِزَ فِي الْبَیْعَۃِ، وَلَا یُصَافِحُ الشَّوَابَّ
"Nabi E Kareem ﷺ bait kartey waqt umar raseedah auraton se musaafaha kartey thhey, albatta jawaan auraton se musasfaha nahi karte thhey."

● Sayyiduna Abu Bakr (Razi Allahu Anhu) ke barey mein yu bayaan kiya gaya hai:
کَانَ یُصَافِحُ الْعَجَائِزَ
"Aap Razi Allahu Anhu umar raseedah auraton se musaafaha kartey thhey."
(al-Mabsoot Lil Sarakhsi al-Hanafi: 10/154, al-Hidaayah: 2/461)
Tabsira:
Lekin yeh teeno jhooti riwayaten hai. muhaddiseen kiraam ki kitabon mein inka zikr tak nahi milta. naam nihaad fuqaha ne ghhad kar Rasoolullah ﷺ aur Abu Bakr (Razi Allahu Anhu) ki taraf mansoob kardi hain.
Al-Haasil: Ghair mahram auraton se musaafaha karna na-jayiz aur haraam hai.
